1. Identity and Applicability
These Terms and Conditions apply to every offer made by and every agreement concluded with AKAZA, established in the Netherlands, relating to products and services offered through akazacards.com and, where applicable, through other sales channels operated by AKAZA.
AKAZA may also be referred to as AKAZA Cards or akazacards on social media and third-party sales platforms. However, the contracting party for purchases made from AKAZA remains AKAZA.
By placing an order, the customer confirms that they have read and accepted these Terms and Conditions. These Terms and Conditions will be made available before or at the time the agreement is concluded in a manner that allows the customer to view and save them.
All mandatory rights arising from Dutch and European consumer protection law remain fully applicable to consumers.
2. Offers and Product Information
AKAZA sells trading cards, graded cards, collectibles, singles, sealed products and related items.
We make every effort to display product descriptions, images, grades, certificate numbers, prices and other product information as accurately as possible. Minor differences in colour may occur due to screen settings, photography and lighting conditions.
Obvious errors or mistakes in an offer, such as evident pricing, textual or data-entry errors, are not binding on AKAZA where the customer could reasonably have understood that an error had occurred.
All offers are subject to availability. Many graded cards and collectibles are unique items with only one copy available.
3. Graded Cards and Certification
Graded cards offered as such by AKAZA have been graded and encapsulated by independent grading companies such as PSA, Beckett/BGS and ARS.
The assigned grade represents the opinion of the relevant grading company. AKAZA has no influence over this assessment and does not guarantee that a card will receive the same grade in a future regrade, crossover or reassessment.
Where available, AKAZA provides the certification number of the slab. Customers may verify this number directly with the relevant grading company.
AKAZA does not guarantee the future market value, price development or collectible value of trading cards or collectibles. The value of collectibles may increase or decrease.
Brand names such as Pokémon, Yu-Gi-Oh!, One Piece, Dragon Ball, PSA, Beckett/BGS and ARS belong to their respective rights holders. These names are used solely to identify the products offered. Unless expressly stated otherwise, AKAZA has no official commercial affiliation with these rights holders.
4. Prices
All consumer prices displayed on the webshop include applicable VAT unless expressly stated otherwise.
Any applicable shipping costs will be displayed before the customer finalises the order.
AKAZA may change its prices at any time. Price changes do not affect agreements that have already been concluded.
Changes in the collectible market after an order has been placed do not entitle either AKAZA or the customer to subsequently alter the agreed purchase price. Statutory consumer rights, including the right of withdrawal where applicable, remain unaffected.
5. Conclusion of the Agreement
The agreement is concluded when the customer places the order and AKAZA confirms the order, unless there is an obvious error or another legal reason preventing a valid agreement from being formed.
AKAZA reserves the right to refuse or cancel an order where there is a legitimate reason to do so, for example in cases of suspected fraud, payment issues, an obvious pricing error or where a product is unavailable due to an inventory error.
If AKAZA cancels an order that has already been paid for, the amount paid for that order will be refunded.
6. Payment
The available payment methods are displayed during checkout.
The customer is responsible for providing complete and accurate payment, billing and contact information.
An order may only be processed after successful payment, unless another payment arrangement has expressly been agreed.
7. Delivery and Shipping
Orders are shipped to the address provided by the customer during checkout. The customer is responsible for verifying the accuracy of this information before confirming the order.
AKAZA carefully packages trading cards and slabs to minimise the risk of damage during transport.
Any stated delivery times are estimates unless a guaranteed delivery date has expressly been agreed.
For consumers, the risk of loss or damage generally passes only when the order has been received by the consumer or by a third party designated by the consumer.
In the event of visible shipping damage, we ask customers to contact us as soon as possible and, where possible, provide photographs of the packaging and the product. This does not affect the consumer's statutory rights.
For shipments to countries outside the European Union, import duties, local taxes or customs clearance fees may apply. Unless expressly stated otherwise during checkout, these costs are the responsibility of the recipient.
8. Right of Withdrawal
For distance contracts, consumers generally have the statutory right to withdraw from the agreement within 14 days after receiving the product, without giving a reason.
Consumers may exercise this right through the online withdrawal function available on our website or by providing AKAZA with another clear and unambiguous statement that they wish to withdraw from the agreement.
After withdrawal, the product must be returned within the applicable statutory period.
The consumer may only handle and inspect the product to the extent necessary to determine its nature, characteristics and functioning. Where a product has been handled beyond what is necessary or has been damaged, the consumer may be liable for any resulting reduction in value to the extent permitted by law.

Statutory exceptions to the right of withdrawal remain applicable where relevant.
9. Returns and Refunds
For practical information regarding returns, return shipping costs and refunds, please refer to the current Return and Refund Policy available on akazacards.com.
This policy supplements these Terms and Conditions and does not restrict any statutory rights available to consumers.
Refunds will be processed using the applicable payment method unless otherwise agreed or legally permitted.
10. Conformity and Statutory Warranty
AKAZA warrants that delivered products comply with the agreement and have the characteristics that the customer may reasonably expect from them.
All statutory conformity rights available to consumers remain fully applicable.
For collectibles and used or older trading cards, the nature, age, stated condition and any clearly disclosed characteristics or defects of the product will be taken into account when determining what the customer may reasonably expect.
A grade assigned by PSA, Beckett/BGS, ARS or another independent grading company does not constitute a commercial warranty from AKAZA regarding future condition, market value or the outcome of any future reassessment.
11. Complaints and Order Issues
If a product has been delivered incorrectly, arrives damaged or does not correspond with its product description, customers are requested to contact us as soon as possible at info@akazacards.com.
Please include the order number and, where relevant, clear photographs of the product and packaging.
AKAZA will assess complaints carefully and respond within a reasonable period. This does not limit any statutory rights available to consumers.
12. Accounts and Customer Information
Where customers use a customer account, they are responsible for keeping their login credentials confidential.
Customers are responsible for ensuring that the information provided is current and accurate.
AKAZA may restrict or suspend an account in cases involving fraud, abuse, security risks or other unlawful use.
13. Use of the Website
The website may not be used for unlawful purposes or in any manner that could interfere with its operation, security or availability.
It is prohibited, among other things, to distribute malware, circumvent security measures, use fraudulent information or collect data through automated means without permission where this would violate applicable law or our rights.
14. Intellectual Property
Unless otherwise stated, intellectual property rights relating to content, photography, design, text and other materials created by AKAZA belong to AKAZA or are lawfully used by AKAZA.
Such materials may not be copied, published, commercially exploited or otherwise used without prior permission, except where permitted by law.
Rights relating to product names, logos, characters, card artwork and other materials belonging to third parties remain with their respective rights holders.
15. Third-Party Services and Links
AKAZA may use third-party services, including Shopify, payment providers, delivery companies, grading companies and external sales platforms.
Additional terms and conditions from these third parties may apply to their services.
AKAZA is not responsible for the content of external websites linked from our website, except where otherwise required by law.
16. Liability
AKAZA is liable for damages to the extent that such damages are attributable to AKAZA under applicable law.
Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is not legally permitted.
AKAZA is not liable for decreases in the market value of trading cards, changes in collectible prices, the outcome of future grading or regrading, or other developments outside AKAZA's reasonable control.
For business customers, liability may, to the extent permitted by law, be further limited to the amount of the relevant agreement or the amount paid out under an applicable liability insurance policy.
17. Force Majeure
AKAZA is not liable for delays or failures resulting from circumstances outside its reasonable control, including disruptions involving carriers, payment providers or technical service providers, natural disasters, war, government measures, widespread outages or other events of force majeure.
Mandatory consumer rights remain unaffected.
18. Privacy and Personal Data
Personal data is processed in accordance with the AKAZA Privacy Policy.
Further information regarding data processing, retention periods and the rights of data subjects can be found in that policy.
19. Changes to These Terms and Conditions
AKAZA may amend these Terms and Conditions from time to time, for example as a result of changes in legislation, business operations or the services offered.
The version that applied at the time an order was placed will generally continue to apply to that agreement.
The most current version is always available on akazacards.com.
20. Governing Law and Disputes
Agreements with AKAZA are governed by Dutch law.
Where the customer is a consumer, this choice of law does not deprive the consumer of any mandatory consumer protection rights available under the law of the country in which the consumer resides.
In the event of a dispute, the parties will first attempt to resolve the matter amicably.
If no resolution can be reached, the dispute may be submitted to the competent court in accordance with the applicable legal rules.
